This Privacy Policy applies to the free informational courses, webinars, educational guides and other educational materials made available by ELAB through the Teachable platform (the “Courses”).


1. Data Controller

The controller of your personal data is Elab Education Laboratory spółka z ograniczoną odpowiedzialnością spółka komandytowa, a limited liability company limited partnership incorporated and existing under the laws of Poland, having its registered office in Warsaw at ul. Nowogrodzka 68, 02-014 Warsaw, Poland, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS No. 0000696577, tax identification number (NIP) 7010719386, REGON No. 36843741800000 ("ELAB").

2. What personal data do we collect?

When you register for a Course or interact with us through the Course platform, we may collect and process:

* your name and surname;

* email address;

* country of residence;

* information relating to your participation in the Course;

* communications exchanged with ELAB;

* technical information such as IP address, browser type, device information, login information and other data generated through use of the Course.


Providing personal data is voluntary; however, certain information is necessary to register for and access the Course.


3. Purposes and legal bases of processing


Course Administration
To register you for the Course, provide access to educational materials and communicate with you regarding the Course.

Legal basis: Article 6(1)(b) GDPR (performance of a contract or taking steps prior to entering into a contract).


Participant Support

To respond to questions, requests and communications relating to the Course.

Legal basis: Article 6(1)(f) GDPR (ELAB’s legitimate interest in supporting Course participants).


Improvement of Educational Services

We may analyse participation and use of the Course in order to improve educational content and the quality of our services.

Legal basis: Article 6(1)(f) GDPR.


Marketing Communications

Where you separately consent, we may send information regarding ELAB services, educational events, study programmes and other educational opportunities.

Legal basis: Article 6(1)(a) GDPR.


You may withdraw your consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.


Legal Compliance and Protection of Rights

To comply with legal obligations and to establish, exercise or defend legal claims.

Legal basis:Article 6(1)(c) and Article 6(1)(f) GDPR.


4. Recipients of Personal Data

Your personal data may be disclosed to trusted third parties acting on ELAB’s behalf, including:

* Teachable Inc., as the provider of the learning platform;

* providers of hosting, cloud, IT and email services;

* legal advisers, auditors and consultants;

* entities providing administrative, operational or organisational support to ELAB.


We do not sell your personal data to third parties.


ELAB Group Entities

Your personal data may be shared within the ELAB group and with affiliated entities where necessary for administrative, operational, educational, advisory, marketing or customer-support purposes connected with ELAB’s educational services.

These entities may include:

* Elab Education Laboratory S.R.L., a limited liability company incorporated and existing under the laws of Italy, having its registered office at Via Cassiodoro 19, 00193 Rome, Italy, entered in the Register of Companies maintained by the Camera di Commercio di Roma (Rome Chamber of Commerce) under REA No. RM-1548251, VAT No. 14819751000;

* Elab Academy, S.L., a company incorporated and existing under the laws of Spain, having its registered office at Calle José Abascal 44, 28003 Madrid, Spain, registered under tax identification number (CIF) B22504971;

* Fundacja Elab Education Laboratory, a foundation incorporated and existing under the laws of Poland, having its registered office in Warsaw at ul. Nowogrodzka 68, 02-014 Warsaw, Poland, entered into the Register of Associations, Other Social and Professional Organisations, Foundations and Independent Public Healthcare Institutions of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS No. 0000523875, tax identification number (NIP) 7010439209, REGON No. 147425760;

* other ELAB-affiliated entities supporting the provision of educational, advisory, administrative, marketing or student-support services.


All such entities process personal data in accordance with applicable data protection laws and appropriate contractual and organisational safeguards.


Educational Partners

Participation in a free informational Course does not automatically result in the disclosure of your personal data to universities, schools, educational institutions, recruitment partners or other educational partners of ELAB.

Your personal data may be shared with such entities only where:

* you specifically request information regarding a particular institution, programme or educational opportunity;

* you request an introduction, consultation or support relating to an application process;

* such disclosure is necessary to respond to your enquiry or provide services requested by you; or

* you have separately consented to such disclosure where consent is required under applicable law.

Any disclosure will be limited to the minimum scope necessary for the relevant purpose.


Educational partners receiving personal data are independently responsible for complying with their own obligations under applicable data protection legislation.


5. International Transfers

Because ELAB uses Teachable and other technology providers, your personal data may be processed outside the European Economic Area (“EEA”).


Where personal data is transferred outside the EEA, ELAB ensures that appropriate safeguards are implemented in accordance with Chapter V GDPR, including:

* Standard Contractual Clauses approved by the European Commission;

* adequacy decisions adopted by the European Commission; or

* other lawful transfer mechanisms permitted under GDPR.


6. Data Retention

Personal data is retained only for as long as necessary for the purposes for which it was collected.

As a general rule:

* Course participation data is retained for the duration of the Course and for up to three (3) years thereafter;

* correspondence and participant enquiries are retained for up to three (3) years following the last contact;

* marketing data is retained until consent is withdrawn or an objection is raised;

* data required by law is retained for the period required by applicable legislation;

* data necessary for the establishment, exercise or defence of legal claims may be retained until expiry of the applicable limitation period.


Following the expiry of the relevant retention period, personal data will be deleted or anonymised.


7. Your Rights

Subject to applicable law, you have the right to:

* access your personal data;

* obtain a copy of your personal data;

* rectify inaccurate personal data;

* request erasure of your personal data;

* restrict processing;

* object to processing based on legitimate interests;

* receive your personal data in a portable format;

* withdraw consent at any time where processing is based on consent.


You also have the right to lodge a complaint with the competent supervisory authority.


8. Cookies and Analytics

The Teachable platform and related service providers may use cookies and similar technologies necessary for operation of the Courses, user authentication, analytics and service improvement.

9. Minors

The Courses are intended for individuals who are at least 16 years of age or who have reached the minimum age required under the laws applicable in their country of residence to independently consent to the processing of personal data in connection with online services.


If you have not reached the required age, you should access and use the Courses only with the knowledge and consent of your parent or legal guardian.


ELAB does not knowingly collect personal data from children in violation of applicable law. If we become aware that personal data has been provided by an individual who does not meet the applicable age requirements, we may delete such data or take other actions required by law.


10. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect legal, technical or operational developments.

The current version will always be available on the Course page.
